We recommend assessing mandamus when a passport request delay reflects an outstanding legal duty that IRCC has unreasonably failed to perform, despite a clear request for action and reasonable time to respond. A writ of mandamus allows the Federal Court to compel performance of that duty. Approval and passport delivery remain separate questions.  Losing access to your passport creates immediate difficulties, especially when travel or an employer requires the original document. Our starting point is to establish whether Immigration, Refugees and Citizenship Canada (IRCC) is still completing your application, holding your passport after a decision, or waiting for a visa application centre or courier to return it.  That distinction determines where to direct an urgent request and whether court proceedings fit the problem. An approval message deserves close attention, but you still need confirmation of what has been issued and where your passport is located.

What Can You Do When IRCC Has Not Returned Your Passport?

We recommend confirming receipt and location first, then requesting a specific update or urgent return from the responsible office. Preserve the submission records and correspondence so that any escalation addresses the precise step holding up your passport.

What Does a Passport Request Mean, and Is Your Visa Approved?

An IRCC passport request indicates that your application has reached a stage requiring your passport or passport details for further processing. We treat the request letter as the controlling instruction: its wording identifies what you must submit and the applicable deadline.  A request frequently signals that an application is approaching completion. Visa issuance still requires confirmation. Check your account for a final decision, any visa document details, and messages explaining outstanding requirements.

For a “visa approved no passport” situation, separate these questions:

  • Has IRCC recorded a final decision?
  • Has the visa counterfoil been issued?
  • Has the passport left the processing office?
  • Has the visa application centre or courier received it?

A study permit application also involves a distinction between a travel visa and the permit authorising study. For a permanent residence application, visa issuance and confirmation of permanent residence have their own requirements. Our assessment of an approved application with no PR card addresses a different document and legal stage.

visa application formHow Long Does Passport Stamping and Return Usually Take?

The responsible office’s current instructions provide the most useful benchmark for passport stamping and return. There is no universal return period covering every office, application category, and delivery route.  We recommend recording separate dates for submission to the visa application centre, delivery to the processing office, and dispatch for return. A courier receipt showing delivery to a collection centre establishes a different event from confirmed receipt by IRCC.  Published IRCC processing times concern the application category described in the tool. They should not be treated as passport-return deadlines. A broader immigration application delay and a delay returning an already-issued visa require different timelines and explanations.  Check the request letter and the office’s current guidance before comparing your wait with another applicant’s experience. Local closures, missing return arrangements, or a request for further documents require a specific response.

How Can You Track Your Passport and Request Its Urgent Return?

Start with the organisation shown as holding your passport in the latest reliable tracking record. We recommend pursuing the physical location and the application status as separate enquiries.

  1. Confirm delivery. Save the submission receipt, tracking number, delivery confirmation, and any visa application centre reference.
  2. Check the handover history. Ask whether the passport is at the centre, with IRCC, or awaiting courier collection.
  3. Contact IRCC. Use the IRCC web form or the channel specified in your passport request letter. Include your application number, unique client identifier, and passport submission date.
  4. Request urgent return where necessary. Explain the deadline and attach evidence, such as a medical appointment or an employer’s written requirement.

These practical responses to immigration delays are strongest when each enquiry asks a precise question. Request confirmation of location, the outstanding step, and the procedure for retrieving the original passport.  If you need return before stamping, ask how that affects completion and whether resubmission will be required. Requesting the passport back and withdrawing the immigration application are distinct instructions; state your intention clearly.

What Evidence Shows the Impact on Travel, Identification, and Work?

A dated chronology supported by documents gives IRCC and any reviewing lawyer a usable account of the problem. We recommend starting with the passport request and recording every subsequent handover, enquiry, and response.  Preserve evidence of the consequences alongside the processing record:

  • Travel bookings, cancellation terms, and evidence explaining essential travel.
  • Written requirements to produce original identification.
  • Employer letters identifying travel duties or a specific document-check deadline.
  • Receipts for additional expenses caused by the delay.
  • Medical records or family documents supporting an urgent return request.

Passport retention does not automatically remove work authorization. Your permission to work depends on your immigration status and applicable conditions. An employer’s need to inspect identification is a separate issue that should be described accurately.  For spousal sponsorship or another family reunification matter, document the particular effects of continued separation. A Provincial Nominee Program applicant should retain any relevant provincial correspondence or employment deadlines. Describe actual losses and obligations without presenting anticipated costs as expenses already incurred.

When Does a Passport Hold Become an Unreasonable Delay?

A passport hold becomes legally concerning when the elapsed time exceeds what the outstanding process reasonably requires and the explanation fails to justify it. We assess the particular step involved, together with the full application history. The delay analysis associated with Conille v. Canada asks whether:

  • The delay exceeds the time the nature of the process requires.
  • The applicant and their representative are responsible for the delay.
  • The public authority has provided a satisfactory justification.

Those questions require careful attribution of time. A late response to a document request should be identified separately from a period when IRCC had everything needed to proceed.  Security screening requires a case-specific assessment. Active, complex checks provide context, while a general reference to security screening delays leaves questions about the length of the wait. A fresh document request also needs to be assessed within the existing chronology.  Our approach to mandamus for stalled Canadian immigration cases keeps hardship separate from the legal delay factors. Evidence of serious prejudice supports the circumstances of the application, but significant prejudice is not a standalone requirement under the Conille analysis.

Canada flag in trees after mandamus orderCan Mandamus Compel Action After a Passport Request?

Mandamus is available where the evidence establishes an enforceable public duty that remains unperformed. We first identify that duty and the official responsible for carrying it out.  The framework from Apotex Inc. v. Canada, commonly called the Apotex test, requires consideration of:

  • A public legal duty owed to the applicant.
  • A clear right to performance, including satisfaction of the necessary conditions.
  • A prior demand, reasonable time to comply, and an express or implied refusal.
  • The availability of another adequate remedy.
  • The practical value of the requested order.
  • Equitable considerations and the balance of convenience.

Under Canadian immigration law, the Immigration and Refugee Protection Act supplies the relevant statutory context, while the Federal Courts Act provides authority for mandamus relief. Immigration judicial review also follows specific procedural rules.  Where adjudication remains pending, a mandamus order compelling action seeks performance of the decision-making duty. The resulting decision remains subject to the applicable eligibility and admissibility requirements.  Where a final decision has already been made, passport retention requires individual assessment. Counsel must identify the legal basis for seeking return, the correct respondent, and an effective remedy. A courier delivery problem calls for a different response from departmental inaction.

What Should You Do Before Starting Federal Court Proceedings?

We recommend a documented demand for the outstanding action before commencing litigation. The demand should identify the duty at issue and give the responsible authority reasonable time to respond.  A demand letter to IRCC should set out the chronology, previous enquiries, and the precise relief requested. Its response deadline should reflect the circumstances, including genuine urgency; a fixed 15- or 30-day period is not a universal legal rule.  Available GCMS notes from the Global Case Management System help explain recorded processing activity. An ATIP request is a useful evidence-gathering option, although obtaining notes is not a mandatory precondition to mandamus. Notes also represent a snapshot and sometimes contain withheld information.

Other steps to address a slow Canadian immigration process include a focused follow-up or an enquiry through your Member of Parliament’s office, where appropriate. An immigration lawyer should assess whether those avenues offer an adequate remedy and whether further waiting is reasonable. If IRCC issues a refusal, obtain advice promptly. The Federal Court process for IRCC refusals concerns review of a decision and carries statutory deadlines that differ from an ongoing-delay assessment.

How Do You File a Mandamus Application, and What Can It Cost?

An immigration mandamus application proceeds through an application for leave and for judicial review in the Federal Court of Canada. We recommend legal advice on both the proposed order and the evidence before filing.  The initial application uses Form IR-1. Filing and service are followed by the required applicant’s record, including affidavit evidence and written legal argument. The Court considers permission to proceed; if leave is granted, the matter moves towards a hearing under the applicable directions.  You are entitled to represent yourself. A licensed lawyer offers assistance with Federal Court procedure; an immigration consultant’s authorisation alone does not permit them to act as your court counsel.  For the mandamus application cost, request an itemized written estimate:

Cost item What to check
Federal Court filing fee The immigration leave application fee is $50; confirm the fee at filing.
ATIP request An Access to Information Act request carries a $5 application fee; other access routes have different rules.
Legal fees Ask whether the quote covers the demand, filing, leave stage, and hearing.
Disbursements and taxes Clarify service, translation, affidavit, and other document expenses.
Possible costs exposure Ask counsel about the rules governing costs in immigration proceedings.

The total mandamus cost in Canada varies with the work required and the stage at which the dispute ends. Obtain a separate hearing estimate if the initial retainer covers only the early stages.

Mandamus proceedings also have a variable duration. IRCC action during litigation sometimes resolves the outstanding issue, while a contested proceeding requires further procedural steps. Before authorising a retainer, ask counsel to identify the duty being enforced, the proposed order, and how urgent passport-return efforts will continue while the court file progresses.
